This software platform is developed and owned by iMX. Company (hereinafter referred to as "iMX"). We hereby remind you (users) to read this "User Agreement" (hereinafter referred to as "Agreement") carefully before becoming a registered user, to ensure that you fully understand the terms of this agreement. Please read carefully and choose to accept or not to accept this agreement. Unless you accept all the terms of this agreement, you have no right to use the services covered by this agreement. Your purchase, use, etc. will be deemed acceptance of this agreement, and you agree to be bound by the terms of this agreement. This agreement stipulates the rights and obligations between HiVoice and users regarding the software platform services (hereinafter referred to as "services"). "User" refers to an individual who purchases and uses this service. This agreement can be updated by iMX at any time. Once the updated agreement terms are announced, they will replace the original agreement terms without further notice. Users can check the latest version of the agreement terms on the official website. After HiDoby revises the terms of the agreement, if the user does not accept the revised terms, please stop using the services provided by HiDoby immediately, and the user's continued use of the services provided by HiDoby will be deemed to accept the revised agreement.
1. Service content
1. The specific content of this service is provided by iMX according to the actual situation, including but not limited to the functions of data management, agent management, chat session, automatic reply, community marketing and other functions realized by authorized users through the use of this software platform. iMX can change the services it provides, and the content of services provided by iMX may change at any time; users will receive notifications from iMX about service changes.
2. The services in this software platform include free services and paid services, please visit our payment policy page to learn about the prices and latest offers of all our services. Users can purchase fee-based services through payment methods, so as to obtain permission to use fee-based services. iMX reserves the right to change our monthly/annual fees and other charging standards. Fee changes will be notified to all our subscribers by email and will be reflected on the pricing page of the official website.
3. Due to network policies in China, including Mainland, Hong Kong, and Macau, our website restricts access from IP addresses within these regions. Additionally, users from these countries or regions may encounter difficulties accessing our website even when using VPNs. Moreover, users are not allowed to send Chinese or any other promotional or marketing messages to Chinese recipients through our platform.
2. Account Terms
1. Users must be at least 18 years old to register for a iMX account, or be old enough to sign a binding contract where you are. If the user is under the age of 18, the software platform cannot be used without the consent of the parent or guardian.
2. Users need to register to use this software platform, choose an account name and set a password. User information will be collected and disclosed in accordance with applicable data protection laws and our Privacy Policy. All users must provide true and accurate information when registering for iMX's website or service, and please do not use invalid or someone else's email, as this will reduce account security.
3. iMX reserves the right to verify all user information and reject any user. The user is responsible for all activity on the account and keeps the password confidential. User agrees to notify us immediately of any unauthorized use of your account or any other breach of security. iMX shall not be liable for any loss caused to the user by others using the user's password or account without the user's knowledge or knowledge. If you become aware that someone is using your account without your permission, you should report it to [email protected].
4. Users shall not use iMX software for any illegal or unauthorized purpose. When using the software, the user shall not violate any laws and legal provisions of the jurisdiction where it is located.
5. The ownership of this software platform is owned by iMX. After the user completes the purchase and activation, he/she will obtain the right to use the software platform. The right to use belongs only to the initial purchaser. Gifting, borrowing, renting, transferring or selling are prohibited. iMX has the right to recycle the user's software platform due to business needs.
6. Users can change and delete personal data, registration information, and transmission content on the software platform account, but it should be noted that deleting relevant information will also delete text and pictures stored in the system by the user. The user bears the risk.
7. The user shall abide by the terms of this agreement and use the service correctly and appropriately. If the user violates any of the terms of this agreement, iMX has the right to interrupt or terminate the service provided to the violating user after notifying the user. At the same time, iMX reserves the right to withdraw the software platform and account name at any time.
3. Rules of use
1. Users understand and agree that this software platform only provides users with data management, agent management, chat management, community marketing and other functions, and users must be responsible for all actions they use, including any content transmitted by users and the resulting any consequences. Users should make their own judgments on the content of this software platform and this service, and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, completeness or practicability of the content. iMX cannot and will not be liable for any loss or damage caused by user behavior. If the user finds that anyone violates this agreement or uses this service in other improper ways, please report or complain to iMX immediately, and iMX will deal with it in accordance with this agreement.
2. The user understands and agrees that due to business development needs, iMX reserves the right to unilaterally change, suspend, terminate or cancel all or part of the service content of this service, and the user shall bear this risk.
3. If you have any objection to the terms of service and its modification, you can automatically waive its qualification. iMX does not support any refund application initiated due to the tenth clause of this agreement: force majeure and other exemptions.
4. Users shall not use this software platform to conduct the following behaviors:
(1) Submitting or publishing false information, or stealing other people's avatars or materials, impersonating or using other people's names;
(2) Forcing other users to follow, click on linked pages or share information;
(3) Fabricating facts and concealing the truth to mislead or deceive others;
(4) Using technical means to create false ones in batches;
(5) Use this software platform to engage in any illegal and criminal activities;
(6) Produce and publish methods and tools related to the above acts, or operate or disseminate such methods and tools, regardless of whether these acts are for commercial purposes;
(7) Other acts that violate laws and regulations, infringe on the legitimate rights and interests of other users, interfere with the normal operation of this software platform, or not expressly authorized by iMX.
5. The user shall be fully responsible for the authenticity, legality, harmlessness, accuracy, validity, etc. of the information transmitted by the software platform, and any legal liability related to the information disseminated by the user shall be borne by the user himself, and has nothing to do with the software platform. If any damage is caused to iMX or a third party, the user shall compensate according to law.
6. The services provided by iMX may include advertisements, and users agree to display advertisements provided by iMX and third-party suppliers and partners during use. Except as clearly stipulated by laws and regulations, the user shall be responsible for the transactions carried out based on the advertising information, and iMX shall not be liable for any loss or damage suffered by the user due to the transaction based on the advertising information or the content provided by the aforementioned advertisers.
4. Data storage
1. iMX is not responsible for the deletion or storage failure of the user's relevant data in this service.
2. iMX can determine the maximum storage period of the user's data in this service according to the actual situation, and allocate the maximum storage space for the data on the server. Users can back up relevant data in this service according to their own needs.
3. If the user stops using the service, iMX can permanently delete the user's data from the server. After the service is stopped or terminated, iMX has no obligation to return any data to the user.
5. Product logo and copyright
1. Except that the intellectual property rights involved in advertisements in this service are enjoyed by the corresponding advertisers, the intellectual property rights of the content provided by iMX in this service (including but not limited to web pages, text, pictures, audio, video, charts, etc.) are owned by iMX, However, the exception is that the user has legally obtained intellectual property rights for the content published by the user before using the service.
2. Unless otherwise specifically stated, the copyrights, patents and other intellectual property rights of the software on which iMX provides this service are owned by iMX.
3. The copyright or trademark rights of the graphics, text or their components involved in this service by iMX, as well as other iMX logos, product and service names (hereinafter collectively referred to as "iMX logos") are owned by iMX. Without the prior written consent of iMX, the user shall not display, use or otherwise process the iMX logo in any way, nor shall it indicate to others that the user has the right to display, use, or otherwise have the right to process the iMX logo.
4. The above and any other intellectual property rights legally owned by iMX or related advertisers are protected by law, and users are not allowed to use or create related derivative works in any form without the written permission of iMX or related advertisers.
6. Legal Responsibilities
1. If iMX discovers or receives reports or complaints from others that the user has violated this agreement, iMX has the right to review and delete the relevant content at any time without notice, including but not limited to user information and chat records, and impose penalties including But not limited to warnings, bans, device bans, and function bans, and users will be notified of the results.
2. Users who are banned due to violation of the user agreement can go to iMX customer service to inquire about the ban period, and apply for unbanning after the ban period expires. Among them, the user whose function is banned will automatically restore the banned function after the ban period expires. Banned users can submit appeals to the relevant pages of the iMX website, and iMX will review the appeals and decide whether to change the punishment measures based on its own reasonable judgment.
3. The user understands and agrees that iMX has the right to punish violations of relevant laws and regulations or the provisions of this agreement based on reasonable judgment, take appropriate legal actions against any user who violates laws and regulations, and store relevant information to report to relevant departments in accordance with laws and regulations, etc. Users shall bear all legal responsibilities arising therefrom.
4. The user understands and agrees that the user shall compensate iMX and its cooperative companies and affiliated companies for any claim, demand or loss claimed by any third party, including reasonable attorney fees, due to the user’s violation of this agreement, and protect them from damage.
7. Force majeure and other reasons for exemption
1. The user understands and confirms that in the process of using the service, risk factors such as force majeure may be encountered, which may cause the service to be interrupted. Force majeure refers to unforeseen, insurmountable and unavoidable objective events that have a major impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plague epidemics and storms, and social events such as wars, turmoil, government actions, etc. When the above situation occurs, iMX will try its best to cooperate with relevant units as soon as possible to repair it in a timely manner, but iMX and its cooperative units will be exempted from liability to the extent permitted by law for the losses caused to users or third parties.
2. Like most Internet services, this service is affected by differences in factors including but not limited to user reasons, network service quality, social environment, etc., and may be intruded by various security issues. Harassment; other software downloaded and installed by users or other websites visited by users contain "trojan horse" viruses, which threaten the security of users' computer information and data, and then affect the normal use of this service, etc. Users should strengthen awareness of information security and user data protection, and pay attention to strengthening password protection to avoid loss and harassment.
3. The user understands and confirms that there is a risk of service interruption or failure to meet user requirements due to force majeure, computer virus or hacker attack, system instability, user location, user shutdown, and any other technical, Internet, communication line reasons, etc. , iMX does not assume any responsibility for any losses caused by users or third parties.
4. The user understands and confirms that there are misleading, deceptive, threatening, defamatory, offensive or illegal information from any other person during the use of this service, or anonymous or impersonation information that violates the rights of others iMX shall not be liable for any loss of users or third parties caused by the information and actions accompanying such information.
5. The user understands and confirms that iMX needs to overhaul or maintain the software platform or related equipment on a regular or irregular basis, and iMX does not need to bear any responsibility for service interruption within a reasonable period of time due to such circumstances.
6. iMX obtains the right to deal with violations of laws and regulations or breach of contract in accordance with laws and regulations and this agreement. This right does not constitute an obligation or commitment of iMX, and iMX cannot guarantee timely detection of violations of laws and regulations or breaches of contract or corresponding processing.
7. The user understands and confirms that iMX does not need to bear any responsibility for the quality defects of the following products or services provided by iMX to users and any losses caused by them:
(1) Free services provided by iMX to users;
(2) Any product or service presented by iMX to users.
8. In any case, iMX shall not be liable for any indirect, consequential, punitive, incidental, special or penal damages, including the losses suffered by the user due to the use of this software platform (even if iMX has been informed of such damages) the possibility of loss). Although there may be contrary provisions in this agreement, all responsibilities of iMX to the user, regardless of the reason or behavior, shall never exceed the fees (if any) paid to iMX by the user for using the services provided by iMX.
9. The user understands and confirms that no refund will be given for the inability to use the service due to the user's account being banned, blocked, restricted login, etc., and iMX will not bear any responsibility.
8. Service change, interruption and termination
1. In view of the particularity of network services, the user agrees that iMX has the right to change, interrupt or terminate some or all of the services (including paid services) at any time. If iMX changes, interrupts or terminates the service, iMX shall notify the user before the change, interruption or termination, and shall provide equivalent alternative services to the affected users; if the user is unwilling to accept the alternative service, both parties shall The actual situation is based on the principle of friendly negotiation, and a reasonable solution is discussed in detail.
2. If any of the following situations occurs, iMX has the right to change, suspend or terminate the free service or fee-based service provided to the user without any responsibility to the user or any third party:
(1) According to the law, the user should submit real information, but the personal information provided by the user is not true and fails to provide reasonable proof;
(2) The user violates relevant laws and regulations or the provisions of this agreement;
(3) In accordance with legal regulations or the requirements of competent authorities;
(4) For security reasons or other necessary situations;
(5) Situations caused by social platforms.
9. Other Terms
1. iMX solemnly reminds users to pay attention to the clauses in this agreement exempting iMX from liability and restricting users' rights. Users are requested to read carefully and consider risks independently. Minors should read this agreement accompanied by their legal guardians.
2. Any dispute or controversy between the user and iMX should first be resolved through friendly negotiation. If the negotiation fails, the user agrees to submit the dispute or dispute to the jurisdiction of the court where iMX is located.
3. No matter any provision of this agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
